What is incentivised marketing?
Common incentive marketing strategies include sweepstakes and contests as well as scratch-off games or similar online games where users have a chance to win a prize without payment or other "consideration".
Sweepstakes
A sweepstakes is a promotion which awards prizes to entrants based on random chance drawings. No consideration (payment) is required to participate and no skill is involved in determining the winner. Participants may be required to meet certain criteria such as age or residency.
Some locales have restrictions on the use of sweepstake promotions. In the United States, New York, Florida, and Rhode Island have the most stringent restrictions. Puerto Rico, as well as Quebec, Canada also heavily regulate the use of sweepstakes promotions.
Most laws that regulate sweepstakes are designed to ensure that each participant has a fair chance of winning and that the prize is actually awarded as advertised. Laws may also require that the rules are available or prominently displayed in the participants language (as in Puerto Rico and Quebec.)
